Please read this Software License Agreement before downloading or using the PIXILAB Blocks Server (SOFTWARE). This agreement is between you, the end user, and PIXILAB Technologies AB (PIXILAB).

SOFTWARE LICENSE AGREEMENT

1. GRANT OF LICENSE. In consideration of your agreement to abide by the terms and conditions of this Software License Agreement (LICENSE), PIXILAB, as the Licensor, grants you (LICENSEE), a nonexclusive right to use and display the SOFTWARE in accordance with the terms of this LICENSE, on any computer for which you have a valid SOFTWARE license. PIXILAB reserves all rights not expressly granted in this LICENSE.

2. OWNERSHIP OF SOFTWARE. In order to protect its rights under applicable laws PIXILAB does not sell any rights in PIXILAB computer software. Instead, PIXILAB grants the right to use the SOFTWARE by means of a software license. PIXILAB retains title and all intellectual property rights of the SOFTWARE. This license is not a sale of the original SOFTWARE or any copy.

3. COPY RESTRICTIONS. The SOFTWARE and any accompanying written materials are protected by applicable copyright law. The LICENSEE may create backup copies of the SOFTWARE for archival purposes but may not circulate/distribute them in public. Unauthorized copying of the SOFTWARE is expressly forbidden. You may be held legally responsible for any copyright infringement which is caused or encouraged by your failure to abide by the terms of this LICENSE.

4. USAGE RULES. The LICENSEE may not modify, translate, reverse engineer, decompile, or create derivative works based on the SOFTWARE. You may not modify, adapt, translate or create derivative works based on any written materials without the prior written consent of PIXILAB.

5. CONSENT TO USE OF DATA. The LICENSEE agrees that PIXILAB may collect and use data including, but not limited to, technical information about networks, mobile devices, peripherals, systems and application software that is gathered periodically to facilitate software updates, product support and other services to you related to the SOFTWARE.

6. TERMINATION. The LICENSE is effective until terminated. It will terminate automatically without notice from PIXILAB if the LICENSEE fail to comply with any provision of this LICENSE. Upon termination, you shall destroy all copies of the SOFTWARE as well as any associated written materials.

7. TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL PIXILAB BE LIABLE TO YOU OR ANY OTHER PERSON/ENTITY FOR ANY LOST PROFITS, LOST SAVINGS, LOST DATA (AND ANY COSTS OF RECOVERING, REPROGRAMMING OR REPRODUCING ANY PROGRAM OR DATA STORED IN OR USED WITH THE SOFTWARE), OR OTHER SPECIAL, DIRECT, INDIRECT, PUNITIVE, CONSEQUENTIAL OR INCIDENTAL DAMAGES ARISING OUT OF YOUR LICENSING OF THE SOFTWARE. THE AGGREGATE LIABILITY OF PIXILAB ARISING OUT OF OR RELATING TO THE SOFTWARE UNDER THIS LICENSE IS IN ANY EVENT LIMITED TO THE AMOUNT ACTUALLY PAID, IF ANY, BY YOU TO PIXILAB UNDER THIS LICENSE FOR THE SOFTWARE.

8. APPLICABLE LAW AND DISPUTES. This LICENSE is governed by the laws of Sweden and shall benefit PIXILAB, consents to jurisdiction in the courts of Sweden.

This software includes or bundles components or executables from various open source projects.
