You are solely responsible for your conduct and any data, text, files, information, usernames, images, graphics, photos, profiles, audio and video clips, sounds, musical works, works of authorship, applications, links and other content or materials (collectively, "Content") that you submit, post or display via the Service.
You may not post violent, discriminatory, unlawful or infringing photos or other content via the Service. PIXILAB may, but have no obligation to, remove, edit, block, and/or monitor Content that we determine in our sole discretion violates these Terms of Service.
PIXILAB does not claim ownership of any Content that you post on or through the Service. Instead, you hereby grant to PIXILAB a non-exclusive, fully paid and royalty-free license to present all Content that you post on or through the Service on any computer or other display device authorized for use with the Service.
PIXILAB's sole responsibility is providing the Service. Specifically, PIXILAB's obligations do not include suitability or performance of user-provided devices (e.g., visitor's mobile phones), cellular network, on-site hardware or configuration of any systems provided by you. You accept the responsibility of providing all required on-site hardware (e.g., computers, wiring, network connection, display devices) and software (e.g., MacOS/Windows operating system, Google Chrome web browser) with adequate performance and reliability, including any configuration of such hardware and software.
In no event shall PIXILAB be liable to you or any third party in contract, tort or otherwise for incidental or consequential damages of any kind, including, without limitation, punitive or economic damages or lost profits, regardless of whether PIXILAB shall be advised, shall have other reason to know or in fact shall know of the possibility. In no event shall PIXILAB's liability under this agreement exceed the agreed-upon purchase price of the Service, calculated as the number of days the Service was demonstrably unavailable or 3 (three) days, whichever is shortest.
You shall indemnify, defend, and hold PIXILAB harmless from and against any and all claims, actions, suits, demands, assessments, or judgments asserted, and any and all losses, liabilities, damages, costs, and expenses (including, without limitation, attorneys fees, accounting fees, and investigation costs to the extent permitted by law) alleged or incurred arising out of or relating to any operations, acts, or omissions of PIXILAB or any of its employees, agents, and invitees in the exercise of PIXILAB's rights or the performance of the Service under this agreement. Prompt notice must be given of any claim, and PIXILAB will have control of any defense or settlement.
If any provision of this agreement shall be declared by any court of competent jurisdiction to be illegal, void, or unenforceable, the other provisions shall not be affected but shall remain in full force and effect. This agreement shall be binding on and to the benefit of PIXILAB and its employees, heirs, legal representatives, successors, and assigns.
